Turtles are the ones that live in water, tortoises are the land ones  :)

I agree with both Zaida and Nutmeg. Turtles are the marine ones, while tortoises are the land ones(though it may be possibly a tortoise having a bath)I think that because reptiles need to have their skin wet because it could dry out if exposed to sunlight too much.

I figured it out, it's an Eastern Long Necked Turtle. I gather its from the lake down the road, I'll probably have to take it back down there.
